CURRENT SITUATION OF TRANSPOSITION OF EU LEGISLATION INTO ESTONIAN LAW

The Draft Occupational Health and Safety Act

Occupational Safety and Health Act - the basic document which provides legal base for establishing safe and healthy conditions of work.

The Draft consists of following articles: definitions "occupational safety" and "occupational health"; general requirements for working environment, workplace and work equipment; description of physical, chemical, biological, physiological and psychological risk factors; general provisions for female workers, adolescents and disabled workers; duties and rights of employers and workers; duties and rights of employers` and workers` representatives; general requirements for recording, notification and investigation of occupational accidents, occupational diseases and work-related illnesses; principal organisation and functions of occupational health services; the role and functions of the Working Environment Advisory Board, Estonian Occupational Health Centre and the Labour Inspection.

This Act based on the Framework Directive on Health and Safety at Work (89/391/EEC).

The Draft OSH Act provides a legislative basis for the Implementing Regulations. The adoption of the OSH Act will entail a quick transposition of the bulk of EU legislation in the field of health and safety at work.

Supervision over the implementation of regulations will be carried out by the Labour Inspection.

We have prepared the following draft regulations according to EEC Directives:

Regulation of the Government on occupational safety and health requirements for the workplace ( 89/654/EEC ) Planned date of adoption: the end of 1999

Regulation of the Government on safety and health requirements for construction sites (92/57/EEC )

Regulation of the Minister of Social Affairs on the minimum requirements for the provision of safety and/or health signs at work (92/58/EEC)

Regulation of the Government on occupational safety and health requirements for the use of work equipment (89/655/EEC, 95/63/EC)

Regulation of the Government: The procedure for the choice and use of personal protective equipment (89/656/EEC)

Regulation of Government on the health and safety requirements for the working environment exposed to biological risk factors. (90/679/EEC, 93/88EC, 95/30/EC, 97/59/EC and 97/65/EC)

Regulation of Government on the safety and health requirements for work on board fishing vessels. (93/103/EC)

National regulations which have already adopted in the field of occupational health and safety:

Regulation of the Minister of Social Affairs on occupational health and safety requirements for work with Display Screen Equipment

The Regulation was adopted in 1996 and was prepared on the basis of the Council Directive 90/270/EEC.

Regulation of the Government of the Republic: Procedure for manual handling of loads

The Regulation was adopted in 1993.
